The arguments for and against have all been made and its now judgement time.Ashok Kheny,promoter and managing director of the Nandi Infrastructure Corridor Enterprise (NICE),and several other prominent politicians and officials would probably be waiting with bated breath as the Special Lokayukta decides on what is being called the biggest land scam in Bangalore.

Acomplaint was filed on July 17 by TJ Abraham,levelling several charges against NICE.Following three weeks of arguments,Special Lokayukta judge NK Sudhindra Rao,who has become the most feared judge among politicians,will on Friday decide if NICEisreallythehugescamasisbeing made out to be.

Kheny and 103 other people have been accused in the private complaint.They include chief ministers from HD Deve Gowda onwards up to BS Yeddyurappa,57 IAS officers of various state government departments and even a senior advocate who allegedly owns shares in NICE,but also represented KIADB against the farmers.

The arguments so far suggest that the extent of land involved in the alleged scam could be as high as 1,67,000 acres and goes way back to the time when NICE inked a project withthestategovernmenttobuildthe Bangalore-Mysore Infrastructure Corridor (BMIC) and related link roads around Bangalore.It also includes townships to be built along the road.
One the many allegations against the project is that the original companyhadapaid-up share capital of just Rs 70 from seven shares of Rs 10 each.This firm was given government land which was later pledged to raise Rs 1,000 crore.The complainant claims that the company should have had Rs 536 crore in its account to raise this amount.The bank which lent the money is also an accused.

Another allegation is that the land required for the road between Bangalore and Mysore was jacked upto 6,999 acres from the original 3,000 acres with the connivance of officials,politicians.The original agreement was to build a concrete road that would last for 60 years,but what has been built so far is a tar road.Toll is being collected on this road although the road to Mysore is not yet complete.This means commuters are paying to travel from one point of the city to another.
But these allegations pale in significance to the one which suggest that the Bangalore-Mysore Infrastructure Corridor Planning Authority (BMICPA ) was set up with a jurisdiction over 1,67,000 acres.The complainant claims that no one knows what powers this body possesses and states that it was established without any survey being done,a prerequisite for any planning authority.

The complainant goes on to state that Kheny is a member of the authority and is bound to favour decisions that will benefit his NICE project.

Stamp duty exemption allotted to NICE is also alleged to have been used for more land than allotted.NICE also allegedly parted with land in the toll road part as well,violating rules.

The concluding arguments in the complaint will be made on Friday.The judge will then either take cognisance of the complaint and issue appropriate order sordi smiss the case for lack of evidence.However,since an eight volume petition has been placed before the court by the complainant,it is expected that the court may reserve its order on Friday to study the arguments.
